Terms of Use
These Terms of Use (these "Terms") set forth the conditions for using HSK Anywhere and all related applications, websites, content, subscriptions, support features, and other related services provided under the HSK Anywhere brand (collectively, the "Service").
By downloading, viewing, registering for, or using the Service, you are deemed to have agreed to these Terms and the Privacy Policy. If you do not agree to these Terms, you may not use the Service.
The Service is intended for educational and study-support purposes only. It does not guarantee success on the HSK or any other examination, any particular learning outcome, improvement in language ability, the accuracy of diagnostic results, or uninterrupted availability.
1. Scope of the Service
The Service may include Chinese vocabulary study, example sentence display, audio playback, card-based study, multiple-choice study, listening practice, level checks, learning history management, account features, cloud sync and backup, paid plans, and other related features.
The content, supported languages, supported operating systems, supported regions, vocabulary volume, pricing, available features, storable data, and other specifications of the Service may be added to, modified, suspended, or discontinued, with or without prior notice to users.
2. Eligibility and Accounts
The Service is not intended for use by children under 13 years of age. If you are a minor, you must obtain consent from a parent or other legal guardian before using the Service. If a minor uses the Service, such consent will be deemed to have been obtained.
Certain features of the Service may require registration or authentication by email address, Google account, Apple ID, or any other method specified by the Service provider. Users must provide accurate and up-to-date information and are solely responsible for managing their accounts, authentication methods, devices, passwords, and related credentials.
Any action taken through a user's account will be deemed an action of that user. The Service provider is not responsible for any loss or damage arising from unauthorized account use, credential leakage, lost devices, or inadequate account management by the user.
3. Paid Plans, Billing, and Refunds
The Service may offer free plans (for example, Lite) and paid plans (for example, Standard). Details such as available plans, pricing, billing cycles, covered features, free trials, promotions, and other conditions shall be governed by the information displayed in the app, on purchase screens, in the App Store, in Google Play, or otherwise presented by the Service provider.
Purchases, renewals, charges, cancellations, resumptions, and purchase restoration for paid plans may be processed through Apple App Store, Google Play, RevenueCat, or other billing and subscription management infrastructure used by the Service provider. Users must also comply with the terms, billing conditions, and operating rules of those third parties.
The store account used for purchase or subscription management may differ from the account used to sign in to the Service. Plan changes, billing cycle changes, cancellation, restoration, and refund handling may require the user to use the same Apple ID, Google account, store region, device, or store environment that is associated with the original purchase, and may be unavailable if the applicable store or payment provider cannot verify the target product, base plan, or subscription account.
Subscriptions may renew automatically unless canceled by the user before the applicable deadline. The timing and effect of cancellation or billing stoppage are governed by the rules of the store or payment provider used for the purchase.
Except where required by applicable law, the Service provider does not offer refunds, prorated refunds, monthly partial refunds, refunds for unused periods, or difference refunds due to plan changes at the user's request. Whether and how refunds are available will, as a general rule, be governed by the policies of the store or payment provider through which the purchase was made.
The Service provider may change pricing, the scope of free plans, feature limitations, or billing methods on a going-forward basis. Revised terms will apply from the time they are displayed or notified in the app, on the website, on store listings, or by any other method the Service provider deems appropriate.
4. Intellectual Property
All copyrights, trademarks, database rights, know-how, and all other intellectual property rights relating to the Service belong to the Service provider or the relevant rights holders. Any permission granted under these Terms is a limited, revocable, non-exclusive, non-transferable, and non-sublicensable right to use the Service solely for personal and non-commercial purposes.
Users may not copy, reproduce, sell, redistribute, publicly transmit, lend, adapt, decompile, disassemble, reverse engineer, scrape, mass extract study data from, or otherwise use the Service or any part of it in any manner not expressly permitted by the Service provider.
5. Prohibited Conduct
Users must not engage in any of the following conduct:
- Any act that violates laws, public order, morals, or these Terms
- Registering false information, impersonating another person, or transferring, lending, or sharing an account
- Placing an excessive load on the Service, servers, networks, or third-party services
- Unauthorized access, vulnerability probing, security bypassing, use of bots, or any other act that interferes with operation of the Service
- Unauthorized commercial use of content, audio, vocabulary data, example sentences, or other materials in the Service
- Attempting fraudulent purchases, abusive refund claims, payment circumvention, or unauthorized acquisition of paid features
- Jailbreaking, rooting, or otherwise removing device restrictions in a manner that harms the normal operation or security of the Service
- Infringing the rights, interests, reputation, credit, or privacy of the Service provider, other users, or third parties
6. Data, Backup, and Sync
The Service may provide local storage, cloud sync, backup, and restore functions. These functions are provided for convenience only and do not guarantee data integrity, continued storage, immediate synchronization, restorability, prevention of overwriting, or prevention of data loss.
Cloud restore, cross-device sync, logout, account deletion, device changes, app deletion, operating system updates, store purchase state changes, and similar events may overwrite, erase, or make learning history, level check results, settings, or other data unrecoverable. Each user is responsible for confirming necessary matters before using backup, restore, or deletion functions.
If local learning history on a device and learning history associated with a signed-in account differ, the Service may ask the user which data to use. Depending on the user's selection, local data may be overwritten by account data, or account data may be replaced or updated by local data. Users are responsible for confirming their selection before proceeding.
7. Third-Party Services
The Service may use third-party services for authentication, delivery, payments, subscription management, data storage, audio generation, analytics, and other functions. Users acknowledge in advance that all or part of the Service may become unavailable due to such third-party services.
Examples of third-party services used by the Service include:
The above list is illustrative only, and the third-party services used may be added, removed, or changed at any time. The content of such services, service suspensions, specification changes, outages, account freezes, review delays, billing defects, and similar matters are subject to the responsibilities and terms of those third parties.
8. Changes, Suspension, and Termination of the Service
The Service provider may change, suspend, stop, or terminate all or part of the Service without prior notice for maintenance, incident response, security measures, changes in third-party services, legal compliance, business reasons, or any other reason.
If a user violates these Terms, or if the Service provider reasonably determines that the user's conduct is inappropriate for operation of the Service, the Service provider may impose feature restrictions, delete data, suspend purchase functionality, stop synchronization, suspend an account, delete an account, or take any other necessary measures.
9. Disclaimers and Limitation of Liability
The Service is provided on an "as is" basis. The Service provider makes no representation or warranty of any kind regarding the Service, including accuracy, completeness, usefulness, fitness for a particular purpose, continuity, availability, security, error-free operation, uninterrupted operation, device compatibility, learning effectiveness, or suitability for examination results.
Level checks and other evaluation features are provided only as reference indicators for a user's learning status and do not represent actual language ability, qualifications, examination results, or third-party evaluations. Audio, example sentences, translations, explanations, and other content may contain errors, inaccuracies, delays, or outdated information.
The Service provider is not liable, except to the extent caused by reasons attributable to the Service provider, for disadvantages arising from communication failures, device malfunctions, operating system or browser issues, battery depletion, store review processes, third-party service outages, authentication issues, failed purchase restoration, delays in subscription state synchronization, data loss, user mistakes, or similar circumstances.
In the event damage is caused to a user due to the Service provider's slight negligence in contractual non-performance or tort, the Service provider's liability shall be limited to actual, ordinary, and direct damages suffered by the user, and the total amount of liability shall not exceed the greater of (i) the total fees actually paid by the user to the Service provider in connection with the Service during the 12 months immediately preceding the month in which the damage arose, or (ii) JPY 1,000.
Notwithstanding the foregoing, the Service provider shall not be liable for lost profits, indirect damages, special damages, incidental damages, punitive damages, consequential damages arising from data loss, or any other damages that are not actual, ordinary, and direct damages. This paragraph does not apply where the Service provider has acted with intent or gross negligence, or where otherwise required by mandatory applicable law.
10. Feedback
Unless a user expressly requests confidentiality, the Service provider may freely use, analyze, modify, publish, and reflect in service improvements any inquiry, request, improvement suggestion, idea, review, or other feedback submitted by the user, without compensation.
11. Changes to These Terms
The Service provider may revise these Terms due to legal amendments, feature additions, operational needs, or other reasons. Revised Terms will take effect when posted or notified within the Service, on the website, or by any other method deemed appropriate by the Service provider.
If a user continues to use the Service after revised Terms become effective, that user is deemed to have agreed to the revised Terms.
12. Severability
If any provision of these Terms is found invalid or unenforceable under applicable law, the remaining provisions shall remain in full force and effect.
13. Governing Law and Jurisdiction
These Terms and use of the Service shall be governed by the laws of Japan. Any dispute arising between the Service provider and a user in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the district court or summary court having jurisdiction over the location of the Service provider's principal office as the court of first instance.
